TERMS & CONDITIONS

Please read these pages carefully as they will be applied to your course booking.

1. Fees, Registration, Refunds and Venues
1.1 No refund of fees or transfer onto a later course can be offered if you fail to attend on the day of your course for any reason (hospital/doctor/dentist appointment, domestic crisis, travel delays, cold/flu, change of mind, lack of child care, etc.). Fees are not refundable or transferable in this instance. To ensure fairness, these terms apply to everyone, and there are good reasons for them. Unlike many training providers we will run a course, with the overheads that this incurs, even if we have very low student numbers - you may be one of only two students booked which, if you do not attend, may mean cancelling the course, causing loss of time and money to the tutor and other student. In addition our courses are very popular, and it's quite likely that we turned away another student who could have taken your place.

In exceptional circumstances of extreme and sudden onset of illness, you must contact the course tutor, prior to the start of the course, by telephone to explain your absence and to follow up in writing to the tutor and copy to the Principal. You must also provide valid medical proof to evidence your illness – if no medical proof is provided then you will be deemed to have failed to attend and no refund will be offered. Also, if you attend the course but for any reason have to leave prior to completing the course, at the Principal’s discretion she may be prepared, for an additional fee of £25 (plus travel or other expenses, if applicable), to offer you a place on the next available course, which may not be in your area. If you are not able to take up this place, then no refund will be offered.

1.2 Provisional bookings will be held for 7 days only pending receipt of the Registration Form and payment by cheque or card. If these are not received, then the provisional booking will be cancelled and the place offered to another student.

1.3 Cancelling or transferring a course will incur the following:

Change or cancellation of course after booking: £25 fee, plus additional charges below if change or cancellation is made within 14 days of the course date.
Courses cancelled or transferred up to 48 hours before the course date: 100% of fee
Courses cancelled or transferred up to 7 days before the course date: 75% of fee
Courses cancelled or transferred up to 14 days before the course date: 50% of fee.

In the event of a genuine reason for cancellation (proof of which may be required) a request for transfer to a later course will be considered at our discretion, but dates and venues cannot be guaranteed.

1.4 We rarely have to cancel a course, but if we do we will transfer you onto the next date that's convenient for you at no extra charge. We will try to give you at least 48 hours notice of a cancellation (unless exceptional circumstances apply). No refunds can be offered for alteration of a course date.

1.5 The full fee is payable in advance to reserve your place. Your place will not be confirmed until cleared funds have been received as at 14 days before the course date. Deposits may be accepted for courses booked over 3 months in advance at the discretion of the Principal.

1.6 You are accepted onto a course on the understanding that you attend on the date and at the time specified in your confirmation email. Classes will commence promptly at the time stated, irrespective of whether all students are present, and are not delayed for late-comers. Tutors are not responsible for repeating notes or stages missed, and can refuse to admit you at their discretion.

1.7 Fees are not refundable if the course is interrupted or cancelled through circumstances beyond our control.

1.8 We make every effort to hold a course at the location stated. However, as we rely on external venues, we cannot guarantee the course will be held at the location stated. We, therefore, reserve the right to change the venue of the course after your booking has been made. If you are not able to attend at the alternative location, you will be offered the next available date at the location of your choice. No refund will be offered.

1.9 If you are not able to practice your new skills following the course, there is no provision for further tuition included within your course fee – however, you are welcome to attend the course again and you should discuss your requirements with the Principal.


2. Course Manuals and handouts
2.1 Courses manuals are available to be downloaded from the website. On receipt of your full payment you will be provided with a password to enable you to download the document. You are advised to read the manual before attending in order to obtain the most from your day.

2.2 Please bring your manual with you on the day as additional copies will not be available. Paper copies of the manual can be sent to you for an additional payment of £5.00 – if you wish to receive a paper copy please indicate this on your Registration Form and enclose the fee.

2.3 If you require replacement copies of the notes or handouts given to you on the day, these can be sent to you at a cost of £5.00.

2.4 If you require replacement copies of your Diploma, you should make your request in writing to the Principal stating your name, date of the course, subject and enclose the administration fee of £10.

3. Equipment, appearance, clothing and footwear
3.1 You will be advised on the Course Joining Instructions of the equipment, clothing and footwear which you should bring with you. These requirements are for the comfort, health and safety of you and your fellow students.

3.2 Your course tutor reserves the right to refuse to train any student who turns up for a course without the necessary equipment, or whose appearance or clothing are, for any reason whatsoever, deemed unsuitable or inappropriate. Fees are not transferable or refundable in this instance.

3.3 Any items left behind after the course in our St Albans venue will be kept by the Principal for the student to arrange for collection at the convenience of the Principal. The Principal reserves the right to dispose of any items in whatever way she deems fit if they are not collected within 28 days of the date of the course.

3.4 Any items left behind at any other venue are not the responsibility of OASIS-TIME or its agents and OASIS-TIME takes no responsibility for any items lost or damaged whilst students are training at external venues.

4. Diplomas, Insurance and Contra-indications/Contra-actions
4.1 Paying for and/or attending a course does not guarantee the awarding of a diploma or certificate. Diplomas are gained by the successful fulfillment of the criteria set out by the course provider and its accrediting bodies, and the awarding of diplomas is at the discretion of the tutor. In the case of a dispute, the decision of the Principal is final.

4.2 It is your responsibility to check if your insurance company will accept OASIS-TIME Diplomas before making your booking. The Guild will insure all OASIS-TIME students, and you will be provided with information on your course, but no refunds will be given if your insurance company will not accept an OASIS-TIME Diploma.

4.3 Students both give and receive treatments so it is your responsibility to inform your tutor when you book if you have any contra-indications which would prevent you from safely receiving a treatment. We make every effort to provide models where required but we cannot guarantee this. On agreement with your tutor you may bring a model. Models must understand the treatment is being done by students and as such, may not be complete, comfortable, or of a professional standard. Models must also adhere closely to the aftercare advice which will be provided on the day. If you or your model experiences any reactions, either at the time, or immediately after your course, you must obtain medical assistance immediately, and inform the Principal in writing within 3 days of what has occurred, enclosing copies of the medical assistance which has been provided.

5. Disciplinary and complaints procedure
5.1 If any student behaves improperly on the tutor's premises, either before or during the course or assessment, or damages or removes any equipment belonging to the tutor, they will be asked to leave immediately and no refund of fees will be given.

5.2 For hygiene purposes, kits cannot be returned or exchanged. Kits should be examined at the time of collection to ensure they are satisfactory – complaints will not be considered after that time. Refunds will not be given for natural deterioration of products which would have occurred during the passage of time. Natural deterioration will be deemed to occur one month from the date of purchase.

5.3 If you have a complaint about the course then this must be brought to the attention of the tutor at the earliest possible time during the course so that steps can be taken to put things right. If your written feedback at the end of the course is satisfactory, and gives no indication that you were not happy with the course, then any complaint made subsequently will not be considered valid.

5.4 Please note that other people, even if they have paid for your course, cannot make a complaint on your behalf.

5.5 Complaints after the course will be considered within 7 days of the date of the course and should be made in writing to the Principal before the expiry of the 7 day period.

5.6 Complaints will be acknowledged by email within 3 working days of receipt (unless the Principal is on holiday when the acknowledgement will be emailed within 3 working days after her return from holiday). A written response to the complaint will be sent by Royal Mail Recorded Delivery, within 21 working days after the acknowledgement. Students must make arrangements to be available to receive delivery of the response, or to arrange with the Royal Mail to re-deliver at a suitable time. Should the complaint take longer than 21 days to investigate then the student will be informed by email when they may expect to receive the response.

5.7 The Principal’s decision regarding complaints will be final. Your statutory rights are not affected.

5.8 Any compensation will be limited to the amount of the course fee only and subject to the limitations set out in these Terms & Conditions.

5.9 OASIS-TIME shall not be liable for any loss or damage to you or any third parties whatsoever and howsoever arising, whether direct or indirect, whether it be by act or omission on our part but not so as to exclude liability for death or personal injury arising from our negligence.

6. General
6.1 The use of camcorders, mobile phone cameras and audio equipment during a class is not permitted.

6.2 All courses, fees and discounts are subject to change without prior notice. Course material may be varied at our discretion and not all the material contained within the manual may be covered during the course.

6.3 Students unable to understand or speak English will not be permitted to attend courses without the assistance of a suitably qualified interpreter. The student is responsible for this expense.

6.4 Students with learning difficulties or disabilities of any kind must inform the Principal when making a booking.

6.5 These conditions form the main part of the contract between OASIS-TIME and the Student.

6.6 Only the Principal shall be authorised to alter or waive any of the aforementioned terms and conditions.

6.7 These Terms & Conditions may be changed at any time – by booking on the course you are deemed to have accepted the Terms & Conditions. The most up to date version will be sent to you with your course joining instructions but the most recent terms will apply even if you have previously been sent another version. They also supersede any written or verbal communication.

6.8 If any provision of these Terms & Conditions is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the validity and enforceability of the remaining provisions of these Terms & Conditions shall not be affected.

6.9 These Terms & Conditions shall be governed by and construed in accordance with English Law. Any dispute shall be subject to the exclusive jurisdiction of the English courts, to which both parties submit. None of these Terms & Conditions shall be enforceable under the Contracts (Rights of Third Parties) Act 1999 by a third party.

7. On-site training and training for employed therapists
7.1 The tutor will inform the person booking the course of the facilities and equipment (including any physical requirements, e.g. correct length of hair for waxing, ability of students to give and receive a treatment or to provide suitable models, etc) which are required to be provided.

7.2 If these required items and conditions are not provided so that treatments cannot be satisfactorily performed, or if facilities are deemed by the tutor as not satisfactory or unsafe, then OASIS-TIME reserves the right to cancel or curtail the course, or to exclude certain students, without compensation.

7.3 If the trainer attending the course has to pay additional unforeseen expenses, then OASIS-TIME reserves the right to submit an invoice for payment of such expenses – e.g. public parking fees which were not explained at the time of booking, provision of replacement certificates if an incorrect name was provided, etc.

7.4 The tutor will make every effort to arrive at the course on time. However, no responsibility is accepted by OASIS-TIME for unforeseen circumstances which may lead to late arrival. It is important that tutors are provided with correct and accurate address and location details, plus information on parking, and facilities for loading and unloading equipment, etc.

7.5 If training facilities are not on the ground floor, and if parking facilities are not adjacent to the training venue, then the person booking the course must make arrangements for the tutor’s equipment to be transported to the course location.

7.6 It is important that the training area is quiet and private, and that students give their full attention and are not interrupted during the course. No liability can be accepted by OASIS-TIME if students do not attend parts of the course, or if they are trying to perform other duties (such as taking telephone calls or dealing with clients), or become distracted by any other business requirements or any other unforeseen circumstances during the course.

7.7 If a student does not give their full attention, or does not attend part or parts of the course then, at the tutor’s discretion, a Diploma may not be awarded, and no compensation will be offered.

7.8 If a course is interrupted or disturbed for whatever reason, and the tutor considers that training cannot adequately or safely be given, then OASIS-TIME reserves the right to curtail the course without compensation.

7.9 Students reaching the required competency level will be awarded Diplomas. However, employers should note that students will need time to practise new skills, in a non-pressurised environment, prior to working on a full commercial basis. Students will also be informed of the need to practise as much as possible directly following the course.

7.10 Employers should note that following a course, students may not perform the treatment to a commercial quality or speed, and allowances should be made for this.

7.11 OASIS-TIME makes no guarantees regarding the future performance or competency of students, or of their willingness to perform the treatment, as this is beyond our control.

7.12 If students have not been able to practise their skills sufficiently, and additional training is subsequently required, there is no provision for further tuition included within the course fee.

7.13 Please note the Complaints procedure contained within these Terms & Conditions.

7.14 If any of the aforementioned clauses are not met satisfactorily in the opinion of the course tutor, then OASIS-TIME reserves the right to cancel or curtail the course without compensation.
